Just as with court proceedings, the goal of alternative dispute resolution processes is to resolve/settle the family law issues between parties (such as the value, equalization and division of property, parenting, custody or child and spousal support). However, when compared to court proceedings, mediation, arbitration and Rapid Resolution offer an opportunity to, among other things, resolve matters privately, more quickly, at less cost and with less acrimony and divisiveness (which may be harmful to children of the parties).

Any of the alternative dispute resolution processes can commence once the parties agree that they would like to resolve their issues outside of court proceedings. Although the parties may not agree on much, they may agree that an out of court process offers an opportunity to, among other things, resolve matters privately, more quickly, at less cost and with less acrimony and divisiveness. All of the alternative dispute resolution processes can occur prior to commencing court proceedings, early on in the proceedings or even when the case is far along in the proceedings.

The cost for any particular alternative dispute resolution process depends upon how long it will take for the mediation, arbitration, Rapid Resolution or other process to be completed. Typically, the amount of time booked to conduct a mediation, arbitration, Rapid Resolution or other process is for a half-day or full day period, depending upon the nature and complexity of the matters involved. More often than not, matters are resolved within the time booked. Typically, the cost of the mediation, arbitration, Rapid Resolution or other services are shared equally among the parties, unless otherwise agreed by the parties.
