As a Faculty Member, Cheryl Goldhart participated in lectures, presentations and training at the Best Practices in Family Mediation and Arbitration Module for Osgoode Hall Law School, Professional Development’s Family Law Intensive Certificate Program.
The Program is organized into nine comprehensive modules, each of which is tailored to provide an in-depth understanding of family law practice. On April 5, 2023, Cheryl was actively involved in the module focused on Consensual Resolution. This session was designed to equip participants with various strategies for reaching a consensual resolution, including negotiation, family mediation, family arbitration and other forms of Alternative Dispute Resolution (ADR).
The module provided a comprehensive overview of the key options available for dispute resolution (eg. family mediation, family arbitration and other forms of alternative dispute resolution), their advantages, limitations, and potential pitfalls. It also offered insights on how to determine the most suitable option for a client, based on their unique circumstances and needs. A critical aspect of this module was understanding the client’s real desires and effectively managing their expectations to ensure a smooth resolution process.
The module also delved into the practical aspects of family mediation, including the preparation of a mediation brief. It emphasized the importance of Minutes of Settlement, explaining why they are critical and providing guidance on how to draft them effectively.
In addition to the theoretical aspects, the module included two skills workshops. The first workshop focused on preparing the client for a settlement conference, while the second workshop offered a simulated negotiation experience. Participants had the opportunity to engage in a simulated negotiation and receive constructive feedback on their performance, providing a practical, hands-on learning experience.
